Welcome to KidsDoc Telehealth. These Terms of Service ("Terms") govern your use of our telehealth services, website, and related services (collectively, the "Services"). By using our Services, you agree to be bound by these Terms.

Important: Our Services are not intended for medical emergencies. If your child is experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

1. Eligibility and Consent

Geographic Limitations

Our telehealth services are currently available only to patients located in the State of Maryland at the time of the consultation. By using our Services, you confirm that you and your child are physically located in Maryland during the telehealth visit.

Parental/Guardian Consent

If you are seeking care for a minor child, you represent that you are the parent or legal guardian of that child and have the authority to consent to medical treatment on their behalf. You agree to be present during all telehealth consultations for minors.

Age Requirements

Our Services are designed for patients from birth through age 21. You must be at least 18 years old to create an account and use our Services on behalf of a minor.

2. Description of Services

KidsDoc Telehealth provides pediatric telehealth consultations through video conferencing technology. Our Services include:

Video consultations with Dr. Maria Hussain, MD
Medical evaluation and diagnosis when appropriate
Electronic prescriptions sent to your preferred pharmacy
Medical documentation and visit summaries
Follow-up care and messaging (for members)
Referrals to specialists or in-person care when needed

Limitations of Telehealth

You understand and acknowledge that:

Telehealth is not a substitute for in-person examination when physical examination is necessary
Some conditions cannot be adequately diagnosed or treated via telehealth
Technical difficulties may occasionally interrupt or prevent consultations
Dr. Hussain may determine that your child needs in-person evaluation and refer you accordingly

3. Pricing and Payment

Service Fees

Pay Per Visit: $45 per video consultation
Monthly Membership: $69 per child per month for unlimited visits
Sibling Discount: $49 per month for each additional child on a membership

Payment Terms

Payment is due at the time of booking for pay-per-visit appointments
Membership fees are billed monthly on the date of enrollment
We accept major credit cards and debit cards
All fees are in U.S. dollars

Cancellation and Refunds

Appointments may be cancelled or rescheduled up to 2 hours before the scheduled time for a full refund
No-shows or late cancellations are non-refundable
Memberships may be cancelled at any time; cancellation takes effect at the end of the current billing period
No refunds for partial months on memberships

Insurance

KidsDoc Telehealth operates on a direct-pay model and does not bill insurance directly. Upon request, we can provide a superbill that you may submit to your insurance company for potential reimbursement. We make no guarantees regarding insurance reimbursement.

4. User Responsibilities

By using our Services, you agree to:

Provide accurate and complete information about yourself and your child
Notify us of any changes to your contact or medical information
Ensure you have a stable internet connection and appropriate device for video consultations
Be in a private, well-lit location during consultations
Have your child present and visible during the consultation
Follow treatment recommendations and prescribed medications as directed
Seek emergency care when appropriate
Not record consultations without explicit consent

5. Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

Keep your password secure and not share it with others
Notify us immediately of any unauthorized access to your account
Log out of your account after each session, especially on shared devices

6. Medical Disclaimer

Not Emergency Care: Our Services are not intended for emergencies. Symptoms that require emergency care include but are not limited to: difficulty breathing, severe allergic reactions, loss of consciousness, severe bleeding, suspected poisoning, or any life-threatening condition.

The medical information and advice provided through our Services is based on the information you provide and our clinical judgment during the telehealth consultation. While we strive to provide accurate and helpful guidance, medicine is not an exact science, and we cannot guarantee specific outcomes.

7. Prescriptions

Dr. Hussain may prescribe medications when clinically appropriate. You understand that:

Prescriptions are sent electronically to your designated pharmacy
Some medications cannot be prescribed via telehealth due to legal restrictions or clinical appropriateness
Controlled substances are prescribed only when medically necessary and in compliance with applicable laws
You are responsible for picking up and properly administering prescribed medications

8. Privacy and Confidentiality

We are committed to protecting your privacy and health information. Our use of your information is governed by our Privacy Policy and HIPAA Notice of Privacy Practices. By using our Services, you consent to our collection, use, and disclosure of information as described in those documents.

9. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of KidsDoc Telehealth or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

10. Limitation of Liability

To the fullest extent permitted by law:

KidsDoc Telehealth shall not be liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability for any claims arising from use of our Services shall not exceed the amount you paid for Services in the 12 months preceding the claim
We are not liable for damages arising from technical failures, internet connectivity issues, or third-party service providers

11. Indemnification

You agree to indemnify and hold harmless KidsDoc Telehealth, its officers, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or misuse of our Services.

12. Dispute Resolution

Any disputes arising from these Terms or our Services shall be governed by the laws of the State of Maryland. You agree to attempt to resolve any disputes through good-faith negotiation before pursuing legal action.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of our Services after changes constitutes acceptance of the modified Terms.

14. Termination

We may suspend or terminate your access to our Services at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us.
